Terms of Service

These terms are a contract between you and Jobflo, a sole proprietorship operated by Nick Watkins (Reno, Nevada). By creating an account or using the Service, you agree to them. If you're signing up on behalf of a business, you confirm you have the authority to bind that business.
1. Accepting these terms
These Terms of Service (“Terms”) govern your access to and use of Jobflo's website, web app, and any related services (together, the “Service”). If you don't agree, you can't use the Service. Your use of the Service is also subject to our Privacy Policy.
2. Your account
You need an account to use most of the Service. You agree to provide accurate information when you sign up and to keep it up to date. You're responsible for everything that happens under your account, including actions by your employees, contractors, or anyone else you invite. Keep your password secure and notify us at support@jobflo.us if you suspect unauthorized access.
You must be at least 18 years old to create an account.
3. Acceptable use
You agree not to:
- Use the Service for anything illegal or that violates the rights of others
- Send spam, unsolicited messages, or content that's harassing, deceptive, or harmful
- Upload viruses, malware, or any code intended to disrupt the Service
- Try to access accounts, data, or systems you don't have permission to use
- Scrape, crawl, or extract data from the Service except through documented APIs
- Resell, sublicense, or white-label the Service without our written permission
- Reverse engineer or attempt to derive the source code, except where the law allows it
- Use the Service to build a competing product
We may suspend or terminate accounts that violate this section. For serious violations we may act immediately and without notice.
4. Customer data and ownership
You own the data you and your team upload to Jobflo — customer records, job notes, photos, invoices, messages, and similar content (“Customer Data”). You grant us a limited, worldwide, royalty-free license to host, copy, transmit, and display Customer Data only as needed to provide and improve the Service.
With respect to personal data about your customers, you are the controller and Jobflo is the processor. You're responsible for having the legal basis to collect, upload, and process that data.
You can export your Customer Data at any time from your account settings, in CSV format.
5. Subscriptions, billing, and refunds
Free trial
New accounts get a 14-day free trial of the full Pro feature set. No credit card is required to start. If you don't add a payment method by the end of the trial, your account pauses and your data is held for 60 days before deletion.
Subscription fees
Plan pricing is listed on our Pricing page. Monthly plans bill in advance every month; annual plans bill in advance every 12 months. All fees are in U.S. dollars and exclude applicable taxes, which we'll add where required.
Renewals and cancellations
Subscriptions renew automatically at the end of each billing period unless you cancel. You can cancel anytime from billing settings; you'll keep access through the end of the period you've already paid for. There are no early-termination fees.
Refunds
Monthly plans are non-refundable except where required by law. Annual plans may be refunded on a pro-rata basis for the unused portion if you cancel within the first 30 days. Refund requests go to support@jobflo.us.
Price changes
We may change subscription prices. We'll give you at least 30 days' notice before any change takes effect, and the new price will apply starting with your next renewal.
Failed payments
If a payment fails, we'll retry and notify you. If the failure isn't resolved within 14 days, we may suspend the account until billing is current.
6. Payments from your customers (Stripe Connect)
Jobflo helps you accept payments from your own customers via Stripe Connect. When you connect a Stripe account, payments charged through Jobflo flow directly to your Stripe account, not to Jobflo. We never hold or transmit your customers' payment funds.
Your use of Stripe and Stripe Connect is governed by Stripe's Connected Account Agreement and other Stripe terms. You're responsible for keeping your Stripe account in good standing and for any disputes, refunds, or chargebacks against you. Jobflo is not a party to any payment between you and your customer.
If your Stripe account is suspended or closed by Stripe, online card payments through Jobflo will pause until you resolve the issue.
7. Service availability
We work hard to keep Jobflo running smoothly, but we provide the Service on a best-effort basis. We don't guarantee uninterrupted availability on Starter or Pro plans. Custom service-level agreements are available on the Scale plan and for enterprise contracts. We may perform scheduled maintenance and will give advance notice for anything we expect to be disruptive.
8. Third-party services
The Service may integrate with third-party tools (for example, QuickBooks, Stripe, Google Calendar, Zapier, Twilio). Your use of those tools is governed by their own terms. We're not responsible for third-party services or how they handle your data.
9. Intellectual property
Jobflo and our licensors own the Service, including all software, designs, logos, trademarks, and documentation. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes during your subscription. We may use your business name and logo to identify you as a customer in marketing materials; tell us at support@jobflo.us if you'd prefer we didn't.
10. Feedback
If you send us ideas, suggestions, or feedback, you grant us a worldwide, perpetual, royalty-free license to use them without restriction. We won't identify you as the source without your permission.
11. Confidentiality
Each side will protect the other's confidential information with at least the same care it uses for its own — and not less than reasonable care. Confidential information doesn't include anything that is or becomes public through no fault of the receiving party.
12. Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or completely secure.
13. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Each party's total aggregate liability under these Terms in any rolling 12-month period will not exceed the amount you paid us for the Service in that period (or, if you haven't paid anything, USD $100). These limits apply even if a remedy fails of its essential purpose.
Carve-outs. The cap above does not apply to: (a) either party's indemnification obligations under Section 14; (b) either party's breach of confidentiality (Section 10); (c) infringement of the other party's intellectual property rights or misappropriation of trade secrets; (d) your obligation to pay fees owed; (e) liability that cannot be excluded or limited under applicable law (such as fraud or willful misconduct).
14. Indemnification
You agree to defend and indemnify Jobflo against claims, damages, and costs (including reasonable attorneys' fees) arising from your Customer Data, your use of the Service in violation of these Terms, or your violation of any law or third-party right.
15. Termination
You can stop using the Service or cancel your subscription anytime. We may suspend or terminate your access if you materially breach these Terms, fail to pay, or use the Service in a way that creates legal or security risk. On termination, your access ends and your Customer Data is held for 60 days, then deleted from production systems. Sections that by their nature should survive (ownership, disclaimers, liability limits, indemnification, governing law) will survive termination.
16. Changes to the Service or these Terms
We may modify the Service to keep improving it. We may also update these Terms. For material changes we'll give at least 30 days' notice by email or in-app message before they take effect. Continuing to use the Service after the effective date means you accept the updated Terms.
17. Governing law and dispute resolution
Governing law. These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules.
Informal resolution first. If a dispute arises, the parties will first try to resolve it informally for at least 30 days after one party sends written notice to the other. Notice to Jobflo goes to legal@jobflo.us.
Binding arbitration. Any dispute that the parties cannot resolve informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration will take place in Nevada (or remotely by mutual agreement). The arbitrator's award is final and enforceable in any court of competent jurisdiction. Either party may bring a small-claims action in lieu of arbitration if eligible.
Class-action waiver. Each party waives any right to bring or participate in a class, collective, or representative action. Disputes will be resolved on an individual basis only.
Injunctive relief. Either party may seek injunctive or other equitable relief in court to protect its intellectual property rights or confidential information, without first proceeding through arbitration.
If you're a consumer in a jurisdiction with mandatory consumer protections, nothing here overrides your local rights.
18. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between us regarding the Service.
- Assignment. You can't assign these Terms without our consent. We may assign them to an affiliate or in connection with a merger or acquisition.
- Severability. If a provision is unenforceable, the rest of the Terms stay in effect.
- No waiver. Failing to enforce a right isn't a waiver of that right.
- Force majeure. Neither party is liable for delays or failures caused by events beyond reasonable control.
